The competence of a mentally handicapped witness was an issue that had to be addressed both at the time when consideration was given to the admission of her video-recorded interview and also when she was called to give evidence. Her failure to recollect events, as opposed to a lack of understanding or ability to provide intelligible answers, did not on its own render her incompetent.
