Once it was proven that a defendant to charges of driving without a licence and driving without insurance had driven on a public highway the onus was on the defendant to produce the necessary documentation. A defendant's obligations under the Road Traffic Act 1988 s.170 to report an accident resulting in damage or injury to the police was negated neither by police attendance at the accident nor by any conveyance of the defendant to hospital.
