Defence of illegality not available in litigation for breach of patent

The grant of a patent gave rise to private rights and the only relevant interest affected by a breach of patent was that of the patentee whose interest would be sufficiently vindicated by the availability of damages and other remedies. There was no public interest involved which would give rise to the defence of illegality.
