[2009] EWCA Crim 997
Where a restraint order allowed a person to spend up to £250 per week towards his ordinary living expenses he could not use that money to pay a contribution to the Legal Services Commission. A contribution to the Commission to institute judicial review proceedings in connection with the offence in respect of which the restraint order was made was a legal expense for the purposes of the Proceeds of Crime Act 2002 s.41.
