Requiring the assets of a group of companies to be used to pay the remuneration and expenses of a receiver appointed following the making of a restraint order under the Proceeds of Crime Act 2002 s.41 would give rise to a breach of the European Convention on Human Rights 1950 Protocol 1 art.1, given that the Court of Appeal had held that the conditions for making an order and appointing a receiver had not been met.
