[2008] EWHC 854 (Admin)

Orders made under the Children and Young Persons Act 1933 s.39 by a magistrates' court and the Crown Court prohibiting the reporting of criminal proceedings against a barrister were made without jurisdiction. The court could only exercise its inherent jurisdiction to make an order prohibiting the reporting of criminal proceedings if the circumstances were exceptional or unusual, and in the instant case they were not.
