[2011] EWHC 1542 (Admin)

A person was not guilty under the Social Security Administration Act 1992 s.112(1A) of failing to notify of a change of circumstances which would affect his entitlement to housing benefit and council tax benefit, where he was only aware that the change could, as opposed to would, affect his entitlement. Section 112(1A)(d) also required knowledge that he had failed to give prompt notification to the prescribed person in the prescribed manner.
