[2014] EWCA Civ 118

An award issued by the Financial Ombudsman would give rise to res judicata so that acceptance of that award precluded a complainant from starting legal proceedings to pursue complaints which the ombudsman had already decided. The operation of res judicata was not excluded by the Financial Services and Markets Act 2000 s.228(5).
