Where a judge mistakenly sentenced a defendant on the basis of a plea that was no longer pursued, the Court of Appeal was not precluded from sentencing that defendant on the correct basis. Sentences of five and six years' imprisonment for possession of ecstacy tablets were unduly lenient and both were increased to eight years.
