[2007] EWCA Crim 625

A suspended sentence of 51 weeks' imprisonment accompanied by an order for 200 hours' unpaid work imposed on the offender upon his conviction for an offence of attempted robbery which involved the victim being sprayed in the face with an aerosol was found to be unduly lenient, despite the fact that the offender had a serious medical condition and was required to attend hospital shortly after trial. A sentence of two years and three months' imprisonment was substituted.
