Where the Crown made representations to a defendant on which that defendant relied and acted to his detriment by pleading guilty where he would not otherwise have done so, that gave rise to a legitimate expectation that the Crown would not subsequently seek to resile from those representations. Accordingly, the Attorney-General could not seek to refer the sentence imposed on the defendant for being unduly lenient.
