[2004] EWCA Crim 2093
The defendant's convictions for indecent assault were safe as the judge had correctly ruled the indictment was right to be joined and there was no indication he had not taken into account relevant information when refusing to sever the indictment. A fine of £2,000 was unduly lenient, there were no exceptional circumstances which merited a non-custodial sentence, the fine would be quashed and a sentence of 12 months substituted.
