[2008] EWCA Crim 2953
A judge had been entitled to find that a residential property did not form part of the realisable assets of a man convicted of conspiracy where the balance of probabilities showed that although the house was in his sole legal ownership his parents had not intended to make a gift of the beneficial interest when transferring the legal interest in the property to him. However, he was found to have a beneficial interest in a second property occupied by his former wife.
