The judge's sentencing comments on the defendant's basis of plea were ambiguous and it was unfortunate that no Newton hearing was ordered given the potential importance of deciding the precise basis on which sentence was passed. A deferred sentence was unduly lenient for offences of possession of cocaine with intent to supply, possession of cocaine and being knowingly concerned in the fraudulent evasion of duty on tobacco.
