A farmer's two previous convictions for causing animals unnecessary suffering contrary to the Animal Welfare Act 2006 s.4 had rightly been taken into account in ordering his disqualification from owning or keeping equine animals or cattle for 10 years following his further conviction for offences of causing unnecessary suffering. Under the Criminal Justice Act 2003 s.143(2), the court was entitled to have regard to previous convictions and to treat them as an aggravating factor.
