[2013] EWCA Crim 1907

A total sentence of seven months' imprisonment was unlawful, having been imposed in the Crown Court in respect of offences of assault and assaulting a police officer, which had been added to an indictment under the Criminal Justice Act 1988 s.40 and s.41. The Crown Court was limited to the sentencing powers of magistrates and therefore limited to a six-month sentence.
