[2013] EWCA Crim 1372
The Court of Appeal gave guidance on the availability of the defence under the Immigration and Asylum Act 1999 s.31 to an offence under the Identity Cards Act 2006 s.25(1), or the Identity Documents Act 2010 s.4 which replaced it in similar terms, and on the obligation on those representing defendants charged with an offence of possession of an identity document with improper intention to advise them of the existence of a possible s.31 defence.
