It was impossible to determine whether there had been a breach of s.58 Police and Criminal Evidence Act 1984, in denying a suspect access to a solicitor at interview, or if there had been a breach whether that breach had affected the fairness of an interview, when the trial had taken place over ten years ago an there had not been a challenge to the admissibility of the interviews at that trial.
