[2010] EWCA Crim 1249

A judge had been wrong to rule that there was no case to answer against a driver charged with causing death by dangerous driving after he crashed his car at night and a few minutes later another driver died while swerving to avoid it. Whether he had caused the fatal accident was a factual question that should have been left to the jury.
