[2012] EWHC 1821 (Admin)

A conviction for driving over the speed limit was quashed where the defendant had raised the defence of necessity and the magistrates had misdirected themselves as to the correct legal test for necessity, as the possibility that the magistrates might have reached a different conclusion had they directed themselves properly could not be excluded.
