The procedure under the Serious Organised Crime and Police Act 2005 s.134 for authorising demonstrations in a designated area was compliant with the European Convention on Human Rights 1950 Art.11 , and there was no need for the state, in its various public authority guises, to justify the necessity to act on the individual facts of the case where a person had been charged with organising or taking part in an unauthorised demonstration in a designated area.
