The Divisional Court could assume that the conduct of the Italian judiciary and its role in protecting individuals' rights under the European Convention on Human Rights 1950 would not be nullified by parallel or subsequent action by the executive arm of the Italian Government so that the individuals' extradition to Italy would not be in breach of their rights under art.3 of the Convention.
