The existence of criminal proceedings in Egypt in respect of the defendant's alleged fraud on the claimants, in which the claimants had lodged a claim for compensation, did not render concurrent civil proceedings by the claimants against the defendant in England vexatious, nor did they amount to harassment. Admissions by the defendant in without prejudice discussions and meetings would be admissible to rebut any denial by the defendant that he was involved in the fraud.
