Badgers sought to be trapped as part of a Government scheme were not property for the purposes of the Criminal Damage Act 1971 s.10 nor at common law and accordingly individuals who destroyed badger traps had neither a defence under s.5 of the Act to charges of criminal damage nor the common law defence of protection of property, which still existed.
