Conduct described in European arrest warrants constituted an extradition offence as the conditions in the Extradition Act 2003 s.64(3) were satisfied. Although extradition would constitute an interference with the rights under the European Convention on Human Rights 1950 Art.8, the instant cases were not exceptional to justify a finding that extradition would be disproportionate to its legitimate aim.
