The Home Secretary had improperly fettered the exercise of his discretion by not considering whether judicial misconduct was so gross as to give rise to an exceptional circumstance within his statement on 29 November 1985 for ex gratia payments to persons who had wrongfully been detained in custody as a result of wrongful conviction.
