To conduct an appeal without a hearing, as required by the Criminal Procedure Rules 2005 r.67.2, against an order restricting public access to part of a criminal trial of an alleged terrorist, would not be incompatible with the European Convention on Human Rights 1950 Art.6. The substantial risk to national security if the information was disclosed to the public had justified the order.
