The Crown Prosecution Service was not entitled to substitute a lesser charge for a more serious charge unless to do so was proper and appropriate to the facts of the case, its application had been made promptly, and considerations of the good administration of justice and the wider picture, for example the situation of any co-accused, had been properly considered.
