[2004] EWCA Crim 631

The appellant's conviction of two counts of obtaining property by deception would be quashed and a conviction of obtaining services by deception would be substituted under Criminal Appeal Act 1968 s.3. The case of R v Wallace Duncan Smith (1998) 2 CAR 1 would be followed in preference to R v Manning (1998) 4 All E.R. 876.
