[2013] EWCA Crim 325

A judge making a confiscation order where a defendant had been convicted of a conspiracy to import heroin, had wrongly included the expenditure incurred in the conspiracy in the recoverable amount, as there had been no finding that the defendant had in fact incurred any expenditure in connection with the conspiracy.
