A judge's order refusing to transfer a representation order, following the breakdown in relations between a defendant and his solicitor, had been vitiated as the judge's ruling had been based on the presumption that the solicitor could be trusted and it subsequently transpired the solicitor had been indicted for criminal offences. As the defendant had had no representation he had been deprived of a fair trial.
