A judge was fully entitled to make an assessment of the overall seriousness of an offence of possession of a prohibited firearm, for example the fact that it had a gang-related background, as long as that was not inconsistent with the jury's verdict. However, the offender's age and lack of relevant antecedents meant that in the instant case the starting point of nine years' detention was too high.
