Two appeals against custodial sentences that had failed to give appropriate credit under the Criminal Justice Act 2003 s.240 for the number of days the appellants had spent in custody on remand illustrated the problems caused by s.240, which could be avoided if judges followed the guidance given in R. v Gordon (Gavin Stephen) [2007] EWCA Crim 165, [2007] 1 W.L.R. 2117.
