There was no evidence of consent by a trade mark proprietor to the importation of motorbikes into the EEA. It could not be said that distributors and dealers who had been authorised by the mark proprietor to sell the bikes in certain recognised territories and had broken their distribution or dealership contract in selling the bikes outside those recognised territories could bind the mark proprietor.
