A defendant seeking to amend his defence to plead that the convictions of other parties for murder were unsafe, and thereby to rebut the presumption of his own guilt arising from their convictions under the Civil Evidence Act 1968 s.11(2), could not do so where his application was late and his supporting allegations were insufficiently particularised and supported to discharge the burden of proof required.
