Article 6(3) European Convention on Human Rights had not altered the established case law based on DPP v Billington (1988) RTR 231 that the exercise of the right to legal advice under s.58 Police and Criminal Evidence Act 1984 was not a reasonable excuse for refusing to provide a breath specimen.
