Magistrates, when dealing with an application for a liability order, had jurisdiction under the Child Support Act 1991 s.33(4) to decide whether the non-resident parent was liable to make payments of child support maintenance, and were required to receive evidence that the parent with care was claiming a benefit authorising the Child Support Agency to recover maintenance unless a concession had been made.
