It was appropriate to refuse an application for permission to make a committal application against a police officer which was advanced on the basis that the officer had wilfully made and furnished a signed witness statement with a declaration of truth which he knew contained false information in contempt of court. The application was totally without merit as there was no evidence that the statement was deliberately misleading or that it was made with no honest belief in its contents.
